The Centers for Food Safety (CFS) and Earthjustice have filed papers in federal district court in Honolulu seeking to enforce a moratorium on the planting, growth, testing or cultivation of genetically modified crops in Maui County, Hawaii.

On Nov. 4, citizens of Maui County voted to halt the cultivation of GE crops until an environmental and public health study is conducted to show that the practice is safe.

Monsanto, and Dow sued contending the moratorium conflicts with state and federal law and should be thrown-out. They also asked that an injunction be placed on the moratorium pending the outcome of the proceedings. Federal Judge Barry Kurren agreed, issuing an injunction to allow time for arguments in the case to be heard. Maui County agreed to wait with enforcing the moratorium until the end of March.

The latest action by CFS and Earthjustice seeks to have the county enforce the moratorium while the case proceeds.
