The start of the first of three civil lawsuits against West Fertilizer has been delayed. The lawsuits stem from the April 17, 2013, explosion at the West Fertilizer facility in West, Texas.
The attorney for the last company named in the lawsuit asked for the postponement in the first trial because that company (El Dorado Chemical Co.) was just named as a defendant in February and the attorney requested more time. Jim Meyer, 170th State District Judge, agreed that El Dorado needed more time since El Dorado Chemical Co.was the last defendant to be named.
The Waco Tribune-Herald reports that “Meyer has divided the plaintiffs into three trial groups and previously had set the first trial to begin Jan. 26, 2015. On Thursday, he moved the first trial to July 2015, which was the original date for the third trial to begin.”
Nearly 200 plaintiffs have filed lawsuits after the explosion.
Adair Grain, owners of West Fertilizer, filed a counterclaim last week against three fertilizer producers and sellers, which makes the company both a plaintiff and a defendant in the lawsuits, The Waco Tribune-Herald reported.
